Terms of Service

1. Acceptance of Terms

By accessing or using The Writer's Engine ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you ("User" or "you") and The Writer's Engine ("we," "us," or "our").

2. Description of Service

The Writer's Engine is a SaaS productivity platform designed to help writers plan, draft, and manage their writing projects. We offer both free and paid subscription tiers. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

4. User Accounts

4.1 Account Creation

To access the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated at all times.

4.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at support@thewritersengine.com if you suspect any unauthorized use of your account.

4.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct we deem harmful to the Service or other users. Upon termination, your right to access the Service will immediately cease.

5. Paid Plans and Billing

5.1 Subscription Plans

The Writer's Engine offers paid subscription plans that provide access to additional features and capabilities beyond our free tier. Details about current plan pricing and features are available on our pricing page at www.thewritersengine.com/pricing.

5.2 Billing and Payment

By subscribing to a paid plan, you authorize us to charge your designated payment method on a recurring basis (monthly or annually, depending on your selection). All fees are stated in US Dollars and are exclusive of applicable taxes.

5.3 Free Trials

We may offer free trials of paid plans from time to time. Unless you cancel before the trial period ends, your subscription will automatically convert to a paid plan and your payment method will be charged.

5.4 Cancellations

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. You will retain access to paid features until your billing period ends.

5.5 Refunds

All subscription fees are non-refundable except where required by applicable law or at our sole discretion. If you believe you are entitled to a refund, please contact us at billing@thewritersengine.com.

5.6 Price Changes

We reserve the right to modify our pricing at any time. We will provide at least 30 days' notice of any price changes via email or an in-app notice. Continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.

6. User Content

6.1 Ownership

You retain full ownership of all content you create, upload, or store through the Service ("User Content"). We do not claim any ownership rights over your User Content.

6.2 License to The Writer's Engine

By using the Service, you grant The Writer's Engine a limited, non-exclusive, royalty-free license to store, process, and display your User Content solely for the purpose of providing and improving the Service.

6.3 Responsibility for Content

You are solely responsible for your User Content. You represent and warrant that your content does not violate any applicable laws or third-party rights, and that you have all rights necessary to grant the license described above.

7. Collection and Use of User Data

7.1 Data We Collect

The Writer's Engine collects certain personal and usage data in order to operate and improve the Service. This includes, but is not limited to:

  • Account information: Name, email address, and password.
  • Billing information: Payment method details (processed securely via our third-party payment provider), billing address, and transaction history.
  • Usage data: Features accessed, session duration, and interaction patterns.
  • Device information: Browser type, operating system, and IP address.
  • Content metadata: Information about your projects (e.g., file names, word counts), but not the content itself unless explicitly required for a feature.

7.2 How We Use Your Data

We use collected data to:

  • Provide, maintain, and improve the Service.
  • Process payments and manage your subscription.
  • Personalize your experience.
  • Send service-related and billing communications (e.g., receipts, renewal reminders, account notifications).
  • Analyze usage trends to enhance performance and functionality.
  • Comply with legal and financial obligations.

7.3 Data Sharing

We do not sell your personal data. We may share data with trusted third-party service providers (e.g., cloud hosting, payment processors, analytics) solely to support the operation of the Service. Any such providers are contractually obligated to protect your data.

7.4 Data Retention

We retain your data for as long as your account is active or as necessary to provide the Service and comply with legal obligations. You may request deletion of your personal data at any time by contacting us at privacy@thewritersengine.com. Note that certain billing records may be retained as required by law.

8. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Upload or transmit malicious code, viruses, or any software intended to harm the Service or its users.
  • Attempt to gain unauthorized access to any part of the Service or its related systems.
  • Harass, abuse, or harm other users.
  • Scrape, crawl, or extract data from the Service without prior written consent.
  • Use the Service for any unlawful or fraudulent purpose, including unauthorized resale of paid plan access.

9. Intellectual Property

All content, features, and functionality of the Service — including but not limited to software, design, text, graphics, and logos — are the exclusive property of The Writer's Engine and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our proprietary materials without express written permission.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE WRITER'S ENGINE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WRITER'S ENGINE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless The Writer's Engine and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

13. Third-Party Links and Services

The Service may contain links to third-party websites or integrate with third-party services. We are not responsible for the content, privacy practices, or terms of any third-party sites or services. Accessing them is at your own risk.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, where appropriate, notify you via email or an in-app notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
